Construction Defects
Construction problems are a common problem in Southern California. We have extensive experience in construction defect cases involving Common Interest Developments, and single family homes. We handle cases either on a contingency basis or an hourly basis depending on the circumstances. Don't assume that a contingency agreement is always the best deal for the client. In many cases, if the settlement is large, an attorney may end up making far more per hour in a contingency contract than would be earned paying an hourly fee. In some cases, our office will only handle a case based on an hourly fee where the amount in dispute is not large enough to warrant a contingency, or recovery is not certain.
The handling of a construction defect case requires a thourough knowledge of all laws pertaining to the subject, including laws concerning statutes of limitations, restrictions on the ability of Associations to file lawsuits against developers, and other pertinent laws. In addition, you need an attorney who is agressive and who has experience trying cases in court to a jury or a judge. Tracy Ettinghoff has been practicing law in Orange County for fifteen years, and he has extensive experience in court. He also has a background in insurance coverage law which is frequently important in these types of cases.
